Dispute resolution process

If Purchaser in good faith disputes any Charge, invoice or amount due under this Agreement (the “Disputed Amount”), Purchaser shall notify to Supplier such dispute and explain the corresponding reasons in writing. Purchaser may withhold any Disputed Amount in good faith and Purchaser shall not be deemed to be in breach of its payment obligations under this Agreement (Withhold payment shall not be subject to late charges). The parties will discuss the dispute in order to solve the issue. In the event the dispute is not solved at the operational level between the relevant parties, Supplier shall address within sixty (60) Business Days from the notice mentioned here above the dispute at the global account managers level, and if the dispute is still not solved at the global account managers level, either Party may escalate the dispute according to the provisions of Clause xx (Dispute Resolution). Dispute resolution clause includes further escalation procedure, with stop provision of referral to binding arbitration, usually before one arbitrator under ICC rules.
