Dispute resolution process

In the event of any dispute or disagreement arising out of or in connection with this agreement or any breach thereof ("Dispute") either party may serve notice upon the other setting out brief details of the Dispute that has arisen ("Notice of Dispute") and the parties shall use their best endeavours to settle such Dispute by good faith negotiation in the first instance by the Buyer’s Representative and the Seller’s Customer Service Representative.
If the Dispute cannot be resolved within 14 days from service of the Notice of Dispute (or such other period as they shall agree in writing) by the personnel described in clause 15.1 then the parties shall submit the Dispute to the Buyer’s Procurement Manager and the Seller’s Manager; and
If the Dispute cannot be resolved within 28 days from service of the Notice of Dispute (or such other period as they shall agree in writing) by the personnel described in clause 15.2 then the parties shall submit the Dispute to the Buyer’s Managing Director and the Seller’s Managing Director.
In the event the Dispute is not resolved within 42 days after it is arisen then the Buyer or Seller may refer the Dispute to litigation through the courts in which case clause 16.13 shall apply.
