Retention clauses

How does this business use retention clauses?

No

Does this business use a standard percentage rate in retention clauses?

No

Does this business apply retention clause practices that are no more onerous than those applied to it on the same project?

Yes:

ISS’s practice is to ensure that retention clauses applied to suppliers are no more onerous than the retention obligations applied to ISS on the same project, unless a different position is specifically justified, documented and approved through the appropriate commercial or legal review process.

Releasing money under a retention clause

Process for releasing money this business has deducted or retained under a retention clause

The release of retentions is in accordance with the Housing Grants, Construction and Regeneration Act 1996, as amended. Amounts are released on application from the subcontractor in accordance with the relevant subcontract terms.

Is the money released in stages?

Yes:

Retentions are released in two parts: the first on completion of the scope of work set out in the subcontract, and the second at the end of the defect liability period. This period is set out in the relevant contract (typically 6 or 12 months) but depends upon the scope of the work undertaken and the risk profile.
